What does ‘communicating for the purpose of prostitution’ mean?

This means an individual has either stopped or attempted to stop a person in order to communicate for the purpose of prostitution. It also includes any individual who is attempting to communicate for the purpose of prostitution will be sufficient to ground a conviction for the offence. Simply attempting can result in a charge. This means that both the prostitute and the person seeking the prostitute’s services can be found guilty of this offence.

What happens if you are convicted of a prostitution offence?

The potential sanction will depend on the offence an individual is convicted of as well as the aggravating and mitigating circumstances of the offence and offender. Many offenders (particularly those charged for the first time with a more minor prostitution charge) will be offered to participate in a diversion program. Those who are not offered diversion may be facing probation or time in custody.

What are the various types of prostitution charges?

The most commonly charged offence is communication for the purposes of prostitution, found in s. 213 of the Criminal Code. This involves any communication or attempted communication for the purposes of prostitution or obtaining the services of a prostitute. This offence is a straight summary conviction offence.

S. 212 of the Criminal Code contains a number of more serious prostitution charges that are straight indictable offences. These include procuring prostitution and living off the avails of prostitution.

S. 211 od the Criminal Code contains provisions with respect to bawdy houses.

Weren’t the prostitution provisions struck down?

In R. v. Bedford, the Superior Court did strike down some of these laws. The Ontario Court of Appeal has since agreed with parts of this decision. The effects of the decisions are stayed and it is expected that the case will make its way to the Supreme Court. At this point one can still be prosecuted for prostitution offences and should comply with the law as set-out int he Criminal Code.

What type of diversion program is available for those charged with prostitution offences?

Diversion is available to those who have sold or attempted to sell sexual services as well as those who have solicited these services. Only the Crown Attorney can agree to divert a case. Generally only first offenders are eligible for diversion although sometimes a Crown Attorney may agree to diversion for a repeat offender. The most common type of diversion is a course put on by an outside agency.
