What is the offence of breaking & entering with intent?

The offence is defined in s. 348(1) of the Criminal Code. Any one who breaks and enters a place with intent to commit an indictable offence, actually commits an indictable offence, or breaks out of the place after committing an indictable offence or after entering the place with the intent to commit an indictable offence, is guilty of the offence of breaking & entering. The Criminal Code further differentiates between breaking & entering into a dwelling house or another type of place.

What is a dwelling house?

Essentially a dwelling house is a place where an individual resides.

Explain the requirement for their to be intent or actual commission of an indictable offence?

Merely entering a place unlawfully is not enough to prove this particular charge. There must be an intent or actual commission or another offence which can be prosecuted by indictment (although hybrid offences may be prosecuted by summary conviction they are deemed indictable until the Crown elects otherwise). In many cases there is an intent to commit, or actual commission of, a theft or robbery.

S. 72 of the Criminal Code sets out the hybrid offence of forcible entry. Therefore if an individual forces there way into a place they can be convicted of breaking & entering with intent to commit an indictable offence. Even in cases where there is no forcible entry the mere possession of break-in instruments, contrary to s. 351(1) of the Criminal Code, could give rise to a conviction of breaking & entering with intent to commit an indictable offence.

What if someone breaks & enters into a place without the intent to commit an indictable offence and does not actually commit an indictable offence?

In such cases they can still be convicted of being unlawfully in a dwelling house contrary to s. 349(1) of the Criminal Code.
